第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。/ j. N& ^- K* ^) Y
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
6 C( E$ `# m e, ] 第三条 中华人民共和国不承认中国公民具有双重国籍。
% ?9 c6 o# k, W; G ^$ l 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
4 B+ y& d3 F2 b3 }! j; v: U$ t 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
3 y q; K2 Z: t( Q 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
! q9 ]% ^/ G% W7 W' k# O) M( \/ u 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:* n# b4 t3 e5 ~: }% j
一、中国人的近亲属;
% @$ F* m6 R/ f1 w+ O 二、定居在中国的;. ^- C. l) g/ w+ C: }2 Y
三、有其它正当理由。+ B: ?$ y* }2 q. |* U, e
第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
6 n$ r* Q+ I* C/ B, N0 V* g 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
! |: H' i8 Y+ f' B T) I% a. [' C, n7 h 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
) W; G& n) L: P 一、外国人的近亲属;& i+ @0 K" B1 W7 h8 `
二、定居在外国的;- M- z" ]& M" Y* N) U
三、有其它正当理由。8 J8 G+ |7 z: U. w
第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
! y! K. v/ m) i# l1 Y: k( T# ?8 x 第十二条 国家工作人员和现役军人,不得退出中国国籍。
$ C1 F, k3 E* }5 f2 p 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。- M$ h8 Z+ _* {
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
, F4 F' h0 ?4 u- S+ K 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
4 _ L. f o1 g* f- z/ v$ g K 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
( M1 C) \( I U H, K9 A! ` 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。# d, i" P1 l0 V5 y3 r: `* D+ b$ Y
第十八条 本法自公布之日起施行。

nationality of the People''s Republic of China.

) K) H& p2 l! s/ @; \The People''s Republic of China is a unitary multinational state; persons
6 i0 |9 S, T j1 p' Sbelonging to any of the nationalities in China shall have Chinese
; S' z6 J8 ~& W8 N4 [nationality.

8 Q Z: {6 S: Z$ hThe People''s Republic of China does not recognize dual nationality for any

Any person born in China whose parents are both Chinese nationals or one& }4 W$ A% [% Z3 F, H* h8 V/ m
of whose parents is a Chinese national shall have Chinese nationality.

Any person born abroad whose parents are both Chinese nationals or one of
0 K$ ?6 y4 I; [whose parents is a Chinese national shall have Chinese nationality. But a
& A) c7 M- X. [. k: Cperson whose parents are both Chinese nationals and have both settled
; v8 p7 ~ C& d% q; Rabroad, or one of whose parents is a Chinese national and has settled0 S5 m, A; B7 ]$ ^4 V4 g
abroad, and who has acquired foreign nationality at birth shall not have% V( @8 Q7 O& r
Chinese nationality.

5 y5 R5 N$ q. J+ V1 I6 mAny person born in China whose parents are stateless or of uncertain
" ?. o j9 g7 p O c! `nationality and have settled in China shall have Chinese nationality.

Foreign nationals or stateless persons who are willing to abide by China''s
( R5 z( P3 O8 A9 NConstitution and laws and who meet one of the following conditions may be
, s$ E7 m* W+ F8 a0 d+ ~* P3 W5 I$ ?naturalized upon approval of their applications:; X) y+ e5 n, T, ]
(1) they are near relatives of Chinese nationals;5 |; ?4 o0 o6 l, ^ T3 V
(2) they have settled in China; or( @) _$ d( T: c$ ^' ]
(3) they have other legitimate reasons.

Any person who applies for naturalization as a Chinese national shall
. D$ x2 x& \2 d( s2 ^. Y1 m$ p3 eacquire Chinese nationality upon approval of his application; a person7 @5 M2 E. O) {' C
whose application for naturalization as a Chinese national has been
1 i: R" x, K- [7 ^approved shall not retain foreign nationality.
( x6 Z) A" Q2 f- dArticle 9( [+ w' U, ?" k- ?- Z5 o
Any Chinese national who has settled abroad and who has been naturalized( @8 R9 V! I6 N1 ?
as a foreign national or has acquired foreign nationality of his own free* X7 s& ^, u" a8 E6 U- c
will shall automatically lose Chinese nationality.

" }' G$ l. @2 f" R7 n) ~/ D1 `7 UChinese nationals who meet one of the following conditions may renounce% V7 r* K5 O, \/ `- Y
Chinese nationality upon approval of their applications:" T6 `, T4 U6 o. |% w( R) c
(1) they are near relatives of foreign nationals;
, ^9 B3 k @* [& y(2) they have settled abroad; or
! v7 J& t+ M q4 P(3) they have other legitimate reasons.

" V% m S! t5 \2 p9 ^6 @Any person who applies for renunciation of Chinese nationality shall lose4 N2 C: x, F# z0 Z9 A! O' J% A- F
Chinese nationality upon approval of his application.7 E% T% m! \9 q Y* y4 L& X
Article 12
9 ` H/ f! F( t9 k7 e* ^' lState functionaries and military personnel on active service shall not
: K. M/ d- A ^/ Zrenounce Chinese nationality.; `7 a1 \3 @" ~% q6 {" `
Article 13
s5 z& l0 D2 ]9 v. C1 f: S! EForeign nationals who once held Chinese nationality may apply for
S, J4 F4 C& O+ qrestoration of Chinese nationality if they have legitimate reasons; those# c. A+ w9 T; B- a! D: P0 M
whose applications for restoration of Chinese nationality have been
5 H5 X* O0 c6 ~2 `approved shall not retain foreign nationality.2 M( O- j! S0 _% A& A
Article 14
9 ^8 N2 i# E) cPersons who wish to acquire, renounce or restore Chinese nationality, with& g. @3 I8 y1 l$ g3 K. E3 _
the exception of the cases provided for in Article 9, shall go through the7 K! Z* i; N0 F$ [6 j; q
formalities of application. Applications of persons under the age of 18
/ ^7 @, m+ m8 o4 Z- b& Cmay be filed on their behalf by their parents or other legal2 m1 V0 t# o5 j- V; S
representatives.
# f6 @- H% w( E) TArticle 158 _4 u m8 j6 r* M" s
Nationality applications at home shall be handled by the public security
% T; J8 o- ?. rbureaus of the municipalities or counties where the applicants reside;
; `, Y5 j9 {! f3 F$ x9 k! nnationality applications abroad shall be handled by China''s diplomatic
% p) T. G- o4 H( F; |0 [representative agencies and consular offices.4 Y% m& O! `! B, M) A; j4 H& D
Article 16
2 k& l9 y, X$ j2 y1 U- W) J; mApplications for naturalization as Chinese nationals and for renunciation
; C& ~# M) _; ^or restoration of Chinese nationality are subject to examination and
$ b3 A2 N: \ b: Dapproval by the Ministry of Public Security of the People''s Republic of
, r6 i8 S) ?1 l9 o1 h. ]China. The Ministry of Public Security shall issue a certificate to any
0 D, P8 M0 Y2 J! v" |1 vperson whose application has been approved.; b* _ {* r# o; H& A1 F! p
Article 178 N2 ?, A J2 \* M
The nationality status of persons who have acquired or lost Chinese
$ y2 i2 l: E& L0 L' |! knationality before the promulgation of this Law shall remain valid.

( c3 A* _! {9 Q/ E @. T& B9 x! ~This Law shall come into force on the day of its promulgation. |
