! W4 J( G) @0 P+ o- H) H 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
# I5 N. D8 ?! E" r0 W. j. V2 j 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
0 }; ~. O2 z. w6 } 第三条 中华人民共和国不承认中国公民具有双重国籍。
5 t& {% S y6 q( b$ D# V 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
2 q5 k; `- B5 ~. R9 g: w 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。1 T% ~; P& ?( e' g" } S
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。' o% W6 q' ?$ h; {7 Z I: f2 M- ?4 n u
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

m6 P* m! `0 m7 I. H 二、定居在中国的;0 i3 S+ t3 I! Y4 s. p0 ^) _: c
三、有其它正当理由。
5 W. |6 N. S5 I$ ^- h 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
: O' Y9 T* p- c 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
$ y* X- y- i2 _; h. Y9 y 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:/ b& u$ `7 s/ v! p( P
一、外国人的近亲属;9 y( Z+ ^ B2 y, x' q6 U$ u
二、定居在外国的;0 e7 B) R- v; R, y; ~
三、有其它正当理由。
$ Y8 s( u/ U% u- w- [5 P0 ^ 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。' B! E+ f# A( \+ _; {# T: D" J* g% \
第十二条 国家工作人员和现役军人,不得退出中国国籍。
: c; |$ q: X; b2 ^ S9 a 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。9 l5 p$ q3 W, i/ |' @
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。- o! ]* G! B; ]1 P W8 l+ C- q
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。0 H4 z0 N2 r4 N8 B" _( U7 L
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
: v4 @# l! ]0 R( Z* g$ K x t8 R 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

The People''s Republic of China is a unitary multinational state; persons
( c: M" c% m4 C: c5 ]" {belonging to any of the nationalities in China shall have Chinese

The People''s Republic of China does not recognize dual nationality for any" F6 }) N& @; L
Chinese national.

of whose parents is a Chinese national shall have Chinese nationality.

Any person born abroad whose parents are both Chinese nationals or one of$ f: e6 @: J5 H$ f/ q+ k
whose parents is a Chinese national shall have Chinese nationality. But a; a* F$ i m7 B( \/ t) T( G
person whose parents are both Chinese nationals and have both settled
, b( }2 a9 @3 e& g) a" F! T/ [9 \abroad, or one of whose parents is a Chinese national and has settled
# Y1 o9 p7 A# j9 M6 x' Jabroad, and who has acquired foreign nationality at birth shall not have* ^5 U% i7 J6 b7 D& f
Chinese nationality.

3 B( o, F3 I& O) l {Any person born in China whose parents are stateless or of uncertain
3 N! u' D" N) e. i6 D* t6 Mnationality and have settled in China shall have Chinese nationality.

+ B! q0 v) J7 t; B* V1 ~Foreign nationals or stateless persons who are willing to abide by China''s( \# E' Z2 t: W k
Constitution and laws and who meet one of the following conditions may be
$ W }+ p* K- lnaturalized upon approval of their applications:3 [9 k: g. Z5 r7 _* V
(1) they are near relatives of Chinese nationals;3 _9 M; G# Z( t- ] H8 L2 \& k
(2) they have settled in China; or
1 n1 |$ Z1 n6 R8 [% y! v! d(3) they have other legitimate reasons.

: F. n" ]* N2 D3 l6 k& V7 L: i0 {" IAny person who applies for naturalization as a Chinese national shall& Q8 F _( l- f! `, w
acquire Chinese nationality upon approval of his application; a person
" l6 N v4 ^3 u! Bwhose application for naturalization as a Chinese national has been0 i4 a; v; L$ u, y3 B' |% @
approved shall not retain foreign nationality.9 l7 M- N" q3 x
Article 9! h1 J- h- _* \! Y5 {9 G. ?
Any Chinese national who has settled abroad and who has been naturalized
0 F$ C# y8 p: Y0 |7 S6 ?. Nas a foreign national or has acquired foreign nationality of his own free
9 T1 q8 k$ a' d' t% Y4 z0 R- jwill shall automatically lose Chinese nationality.$ {) K* q- h( J
Article 10' {( `& y# h' z3 _
Chinese nationals who meet one of the following conditions may renounce
0 B/ Y/ S# h. B( AChinese nationality upon approval of their applications:! v2 w! p/ k4 y6 v9 _3 C3 H
(1) they are near relatives of foreign nationals;; ?# D e! Y+ ^% v1 Z
(2) they have settled abroad; or7 {: l! y) Y2 p: f$ I
(3) they have other legitimate reasons.; v% `! N: X* N3 t2 t2 g
Article 11% z1 E* K I9 b! ^& z7 L: w1 b
Any person who applies for renunciation of Chinese nationality shall lose$ r* \/ c- W* h7 M: U+ l
Chinese nationality upon approval of his application.$ y _9 g, ?4 U0 }0 j* o% v% ]
Article 12: B3 r) S( U/ M5 b: x/ N* t+ v
State functionaries and military personnel on active service shall not8 R5 A/ @2 g7 y8 M, {! {
renounce Chinese nationality.
3 ~* n, ~1 _% p/ @* L# Z# DArticle 133 |, u# w! t0 F
Foreign nationals who once held Chinese nationality may apply for8 l% F s' x R. o! s
restoration of Chinese nationality if they have legitimate reasons; those
) i( ?7 o: @5 R% a, i6 Lwhose applications for restoration of Chinese nationality have been
( N' o; [/ Z, q/ F( papproved shall not retain foreign nationality.
. Q5 i8 \ w/ E% B3 mArticle 144 E& H" S/ E( @& Y
Persons who wish to acquire, renounce or restore Chinese nationality, with! ~# r3 |1 }; a# w$ `
the exception of the cases provided for in Article 9, shall go through the1 U7 b" t- o4 b; r
formalities of application. Applications of persons under the age of 18
! E* m) N* J4 t: A+ Kmay be filed on their behalf by their parents or other legal
. B- B, R) s u: r3 p4 Krepresentatives.
0 W8 D4 P8 F6 l$ r: C" U2 eArticle 15
0 D( M% _- l( zNationality applications at home shall be handled by the public security
R, z/ f- x- ?7 [* \) D* \$ M. Rbureaus of the municipalities or counties where the applicants reside;
# v# a! @' Y- L% G6 Inationality applications abroad shall be handled by China''s diplomatic
! t- M( c6 A8 o, {, R" \7 ~- rrepresentative agencies and consular offices.% K7 h* t) l7 X$ R
Article 16: O8 u# A( k: A% z
Applications for naturalization as Chinese nationals and for renunciation+ J) |, l3 P) E9 |; F Z/ A
or restoration of Chinese nationality are subject to examination and
0 S- L- o1 v8 Z% sapproval by the Ministry of Public Security of the People''s Republic of
1 A; a: N" G V |' GChina. The Ministry of Public Security shall issue a certificate to any
9 u$ a, E4 g$ S, r- iperson whose application has been approved.) ~/ f3 ?" M e Y, G3 ]0 o
Article 17
' R% x, w$ E$ M1 q* l* D! SThe nationality status of persons who have acquired or lost Chinese/ p% R1 P0 ^; Q3 E' q
nationality before the promulgation of this Law shall remain valid.

; ?( H; y1 d8 Z8 LThis Law shall come into force on the day of its promulgation. |
