请教 － 新房建筑问题-建筑商没按FLOOR plan建BASEMENT

今年初买的STERLING HOME S2的新房，今天去ＷＡＬＫ  ＴＨＲＯＵＧＨ（自己主动要求的），到了ＳＨＯＷ　ＨＯＭＥ，售房人员，突然给我一张纸，告诉我有如下改动. 原文如下：

Change the basement stairwell wall from a 6'' to 4'' wall.This change will move the location of the stairwell beam

原来是他们内部做出的决定。我根本就没被告知，纸上也没有我的签字，但是他们自己写上了我的姓名。看完房后，我马上返回ＳＨＯＷＨＯＭＥ对比了下，感觉楼梯的宽度小了。还有这种改动会不会影响绝热保温什么的？

" c  p, k/ O$ K! x9 x2 E更让我生气的事是到了新房去实际看房的时候，发现ＢＡＳＥＭＥＮＴ的FURNACE的位置跟图纸上说的也不一样，往里面挪动了不少。在ＳＨＯＷ　ＨＯＭＥ，它是正对着楼梯口，在新房的ＢＡＳＥＭＥＮＴ，整个炉身都移出了楼梯口到厅里去了。这应该是减少了ＢＡＳＥＭＥＮＴ的可使用面积吧。当时比较新房和SHOWＨＯＭＥ的ＢＡＳＥＭＥＮＴ，给我的感觉就是ＳＨＯＷＨＯＭＥ的大得多。

以上这些是否是建筑商的违约行为？请问各位专业人士和有过相关经验的买房同胞，你们是如何应对的？我今天是当场就填了一份CUSTOMER CARE表格，而且现场对SHOWHOME的售房人员表示了，我不会接受。不知道会有用没有，或有多大的用处？不知道各位知道，有没有什么机构或协会，可投诉或ＣＯＭＰＬＡＩＮ　ＳＴＥＲＬＩＮＧＨＯＭＥ S2 这种行为？

第一次买房就碰上这种事，感觉很不爽。还有，如果最后建筑商答应ＦＩＸ这些，他们是不是会刁难要我额外付钱？我认为这是他们的责任。是不是到时还要有什么新合约要签？

依稀记得，好像合约有一条款说明关於HEAT DUCTS，FURNACE，WATER PIPES，DRAINAGE TUBES等等的RUNNING布置，BUILDER 得按实际情况变动。你可以从其他BUILDERS试探问明，或是问你的律师也可.

就算他们要变动，难道不征求我的签字？还有，买房时，是有图纸的，难道那还可以变来变去？我怀疑是不是他们聘的CONTRACTOR搞错了，不得不将错就错？据售房人员，还有其它6户也有同样的改动？不知道里面有中国同胞没有？

1 e( |) P. j0 d; M9 ?当初买房时，我没有另外请律师，是用的BUILDER的律师。据中介的话，Sterling Home的信誉还不错。不知道我的complain是不是能解决？

还有一个疑问，按他们给的那张纸，staiewell wall 从6‘’变到4‘’，那是不是就说少了3x2=6‘’（因为是三面墙在楼梯处)？

刚刚有看了下Purchase Agreement,有这样一段：

Extra, Deletions or Substitutions
- ?% h3 P6 H6 H. e/ @1 M) e
Any additions, removal, corrections, variationa, substitions or price changes to the Home referred to in Clause 4 shall be done only by a written changes order(s) signed by the Builder and Purchasers and attached to this Agreement (Schedule "C"). ...

- E# L4 S; X1 V1 u( }又检查了下BUILDER给的那张纸(改stairwell wall厚度: 从6''变到4"），是Change Order。上面没我的亲笔签字，是他们写上我的姓而已，都没有我的全名。

Since you have in hand a change order which apparently bears no signature of yours, try talk to the builder and ask for an explanation,

争取再修正，试试无妨，但你用的是BUILDER之LAWYER，相信赢面不大，只要影响非严重性，也就算了罢。这般情况，建新房常会遇到，千万不要有挫折感，气愤也是徒然。

看了下图纸，现在FURNACE是在图纸标的BATH位置。好像是不能改回去了吧？

7 }4 n% M7 b( ]3 o5 v  W& W8 v看了一下，初步推断数点如後，如有不确，请指正                                                                     A。图示为DUPLEX，非SHOWROOM与新建房之对照。 B。红色标示位乃上下段楼梯180度转向之平台位置(LANDING)。  C。红色墙位与原墙位一致(除了左方红线略向右移),只厚度改变。
& y* G9 }" i( d如上述无误，该3幅墙体均在LANDING之下，应不是承重墙，按理厚4寸无问题，梯宽3尺半强，亦符 BUILDING CODE标准。

it's only the foundation plan which was attached when I signed the purchase agreement. My biggest concern is the location of the furnace in the new home that it's moved to the location of the BATH as indicated in the foundation plan I sent you. That change makes me feel the basement room becomes smaller. This can be appreciated when comparing with the basement in the showhome.

不是很明白，按理FURNACE ROOM移了位置，空间变动而已，大小应保持，除非FURNACE ROOM大了，其馀空间才会减细。May be it looks smaller, not really it becomes smaller.

Not a mistake. The gas/water/electrical pipes/lines is completed by City or the developer, not controlled by builders. The the layout of basement is only conceptual design and subject to actual arrangement of pipes/lines. The builders have to follow the codes and change the original location design.
This kind of situation happens for all builders not just for yours.
( y( ?, v9 F7 ]4 R4 s; yDon't worry too much about your basement layout. You can design it after house done.
