第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。# @; S+ U! R2 }9 z
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
6 P( a: O& h. t' V- B    第三条    中华人民共和国不承认中国公民具有双重国籍。
* m+ Q- h4 P8 h0 V    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
) S$ c( z3 t6 j! {) f% o    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
( S, n4 ~- h3 N0 G    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。* i5 x* {4 W* }
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
! B# a! q& q% i% B6 n$ y+ r    一、中国人的近亲属;
/ [) h: p/ a3 \' E; k    二、定居在中国的;7 |  ^1 E$ Y7 f' {, Q: ?
    三、有其它正当理由。
: k1 R2 T* \: `( @( B0 e    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
) J9 K) h6 x" [    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。, x7 Z2 w3 Q; \( T3 |, [7 R- o/ o3 o
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
) d, m6 V8 M& [; g& L( q& \    一、外国人的近亲属;7 `; Q. A! T' w/ d# o
    二、定居在外国的;* L% {% i8 r9 k8 G
    三、有其它正当理由。
$ d' Z7 A6 @! ~) e% r* A    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。( O8 w& p. u# l# w2 `5 y* ^" L+ h
    第十二条   国家工作人员和现役军人,不得退出中国国籍。% R& A# |* Y) o& T# J/ `" V  k
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
. w. r3 `/ }$ f& h1 l/ ^- |! D    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
$ D2 I* P! y+ o! i; L3 v    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。8 Q3 Z! w! b* ^5 [
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
0 Y* t; s; _: e    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。
1 i; }& J0 k7 D    第十八条   本法自公布之日起施行。

Article 1
" e  c" F! a- hThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of( W) X' J' |1 M: {1 N7 U" x
nationality of the People''s Republic of China.$ i, W: T& w; h4 E' r& P. J
Article 2
* |5 O. B0 Z0 hThe People''s Republic of China is a unitary multinational  state;  persons  j9 r$ w6 F! e0 t+ Q; B9 {
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese0 x! @0 g% ^/ e) Q( A2 A" ~
nationality.6 Z/ @5 [8 s! d, v  H( E
Article 3
2 \4 Y! `& P1 `/ P3 KThe People''s Republic of China does not recognize dual nationality for any' ^' k/ u& h4 c5 n1 U+ d& e. G
Chinese national.# C0 ~* i) R% e" r. T. b
Article 4
3 E( q2 j% v% q0 d/ {5 \2 {Any person born in China whose parents are both Chinese nationals  or  one/ p3 P- y) A( V+ Q% |4 |/ `
of whose parents is a Chinese national shall have Chinese nationality./ \2 B& g5 y0 ~9 f* b. g
Article 5
" g$ F0 `" G+ x7 e( \Any person born abroad whose parents are both Chinese nationals or one  of
! {3 y/ g: q( R. k& I  Ywhose parents is a Chinese national shall have Chinese nationality. But  a* Y) [1 K2 P# Y, ]" c1 A+ v
person whose parents are both Chinese  nationals  and  have  both  settled7 z0 p! _$ P, [' c
abroad, or one of whose parents is a  Chinese  national  and  has  settled
! ?6 M2 Y! `: W. kabroad, and who has acquired foreign nationality at birth shall  not  have; j+ k0 I) |% t8 O# ~$ q( k, @5 i7 ~/ i
Chinese nationality.% c5 E8 _$ o/ q3 z" Z3 B
Article 6. ]" i! a$ L- A. \6 f1 K; |6 k
Any person born in China whose  parents  are  stateless  or  of  uncertain3 I  [* y7 w. I0 |! q
nationality and have settled in China shall have Chinese nationality.
/ v" p! E/ ^8 O8 |Article 7
1 n+ o& P* l' [5 P7 P! r! y: r! |Foreign nationals or stateless persons who are willing to abide by China''s9 r$ t- {! v3 h2 h
Constitution and laws and who meet one of the following conditions may  be
: ^3 I' r& [$ X% B3 m/ Unaturalized upon approval of their applications:' S4 ?8 k4 W# b% G6 D
(1) they are near relatives of Chinese nationals;0 B6 n; I+ I  W. ]$ R/ k! d$ |3 P+ e
(2) they have settled in China; or' v+ ^/ S. }: Q! B2 V
(3) they have other legitimate reasons./ q" ~: @+ W$ l# m& s2 q
Article 8
  F: s; n. \! {0 d: O1 GAny person who applies for naturalization  as  a  Chinese  national  shall0 I0 k# z1 E/ G. J5 ~+ N0 Q
acquire Chinese nationality upon approval of  his  application;  a  person7 D  `: t. n0 {3 E. Y
whose application for  naturalization  as  a  Chinese  national  has  been
7 g' H. i3 I0 o9 C& Gapproved shall not retain foreign nationality.
# z' G" o6 E! I* T# EArticle 95 S- {& h8 u9 M  ~: [8 H4 B
Any Chinese national who has settled abroad and who has  been  naturalized, z/ K+ p" C* P0 H0 ?
as a foreign national or has acquired foreign nationality of his own  free0 g. g$ }3 S. {* x" |6 [
will shall automatically lose Chinese nationality.
- _- ~  o1 r% [2 `1 fArticle 108 x3 E9 p- d3 W
Chinese nationals who meet one of the following  conditions  may  renounce; ?* T3 M% ~* n3 z
Chinese nationality upon approval of their applications:- E9 N1 v) O  m" r! V2 v) C
(1) they are near relatives of foreign nationals;
- Q& V+ ]  Y: b7 w(2) they have settled abroad; or: m1 @& U1 O" y1 Y3 X9 b* f9 A  @
(3) they have other legitimate reasons.) \( Z* W4 [) q3 |  u
Article 11
8 M* F) [# y4 r' K& S0 sAny person who applies for renunciation of Chinese nationality shall  lose% ~, Q- g# v; M9 W+ R
Chinese nationality upon approval of his application.% T: F1 }/ H, U1 y: ]
Article 12$ u; C% [; _! E7 N
State functionaries and military personnel on  active  service  shall  not
% t( @/ K+ \2 U0 Lrenounce Chinese nationality.5 V+ U9 o0 `4 U7 ^( A) d$ [' T" X
Article 13, F, R( z( p1 r, C& a; W6 D
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for3 \, a4 f5 ?1 v8 f3 p1 C& h
restoration of Chinese nationality if they have legitimate reasons;  those# [4 o: Q, x( J5 A. I- @) r8 ~
whose applications  for  restoration  of  Chinese  nationality  have  been
4 Q% A: u$ ^& K3 H& A; H  ]approved shall not retain foreign nationality.
, L/ b0 |, L" v- \Article 14% r. Z# g8 O) q5 b0 @" }
Persons who wish to acquire, renounce or restore Chinese nationality, with
" V- V" ^" b5 d7 l% cthe exception of the cases provided for in Article 9, shall go through the
; L5 c! |3 A' ~3 }formalities of application.  Applications of persons under the age  of  18
4 l3 v3 ]2 X. I& mmay  be  filed  on  their  behalf  by  their  parents   or   other   legal
5 m! m" P4 w2 m) ?# Trepresentatives.
- E  z- j: z) T, ~Article 15
( d0 @+ g8 k/ w1 |Nationality applications at home shall be handled by the  public  security
4 \9 W: E+ y, N) a; x. \bureaus of the municipalities or counties where the applicants reside;
1 |; ?/ D& R7 [: V2 dnationality applications abroad shall be  handled  by  China''s  diplomatic! H6 \, |, f0 F8 e
representative agencies and consular offices.) S- J6 T( r- S3 o# g" [1 h' P7 |
Article 16
7 J, {5 M8 I/ X0 F, D" M" HApplications for naturalization as Chinese nationals and for  renunciation8 s' I% W' }- Y
or restoration of Chinese  nationality  are  subject  to  examination  and
  s* `  u; n5 Y" wapproval by the Ministry of Public Security of the  People''s  Republic  of' R! i; S) z' L( C- l
China. The Ministry of Public Security shall issue a  certificate  to  any  T/ f2 r; `' y- t0 Z9 }, a
person whose application has been approved.
! s# D" k3 x6 y5 V/ [% Y9 R( J# z8 aArticle 174 y' c) v2 r/ i  b2 g0 B+ \" w
The nationality status of  persons  who  have  acquired  or  lost  Chinese  ^/ Z' M( E4 t  e5 C; G/ n! z
nationality before the promulgation of this Law shall remain valid." q7 D: h  x& b9 P* @
Article 18( i% I/ a) D8 E( J/ x
This Law shall come into force on the day of its promulgation.
