《中华人民共和国国籍法》 6 r0 i6 j/ q+ q5 u4 Y

第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
8 {$ @  I* h, Z; I, |) I    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。* Z; l7 u; l% s% }" ]( ~- [
    第三条    中华人民共和国不承认中国公民具有双重国籍。8 P1 O9 }0 s+ [; i% U/ a
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。8 o$ z  ~4 a6 Q. S4 U8 R# p& ?
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。6 q* l" S! H1 {* ~  n( h2 L9 r
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。; S3 W) `: e5 ^; y5 V; u' C
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
' g7 h7 w- e' v3 `8 a! K    一、中国人的近亲属;" _4 l' e4 \& d$ f, N" R
    二、定居在中国的;
5 l  V+ d5 H, C: b6 E0 V    三、有其它正当理由。
, z& d4 i; }# j+ {$ x    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
0 g0 _- k, f8 Z+ u    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。1 c9 L/ ~- T5 ^" y8 g
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
; i; s4 j: N+ g    一、外国人的近亲属;, b/ u# m6 \5 ?+ m6 O" `
    二、定居在外国的;
. _; }  \1 m  `6 r2 K% G    三、有其它正当理由。
$ ^8 E* A0 W* \! K- g& _) U) _    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。8 t* T* Y% P# [3 x9 P- p( g& l
    第十二条   国家工作人员和现役军人,不得退出中国国籍。5 W) u- e0 F# ^8 b% R: [  J& h
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
; e! X: K5 l2 K4 ^    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
6 f. u/ f+ d+ I! T- s. {    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。1 t9 a1 C% o0 i& N
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。9 G& |3 |2 p7 N7 N: [
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。/ I' _# [$ @# u2 p9 B7 S
    第十八条   本法自公布之日起施行。

Article 1
% M  ]+ P% q: q5 ^6 j+ O5 X# A4 xThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
3 t7 m7 s/ U/ U& R8 rnationality of the People''s Republic of China.
* [3 P) V- y. E* z9 f0 i$ ^Article 24 s$ q8 v5 Z! k# ?! I
The People''s Republic of China is a unitary multinational  state;  persons0 e2 r( R% `0 O' E7 O9 p
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
; t+ i- y& D  i. F0 q: v- K, ~nationality.
' r2 Y$ {7 }' G- dArticle 3
2 E2 g8 n7 v; u( ]' yThe People''s Republic of China does not recognize dual nationality for any# w4 V5 ?, i: x! y) T! z2 T8 m
Chinese national.
! E# w( I# T) F* ^/ M; C0 lArticle 45 o5 `& T" z6 k( O+ r4 d9 }
Any person born in China whose parents are both Chinese nationals  or  one
7 [- i( ^0 m( t0 ^$ gof whose parents is a Chinese national shall have Chinese nationality.
! \% ~1 K/ W( l3 NArticle 5- G! Y- D" f$ F$ q: N8 f
Any person born abroad whose parents are both Chinese nationals or one  of
- C* [3 m# m0 L% A( \) xwhose parents is a Chinese national shall have Chinese nationality. But  a
# k* F9 q5 `) d2 i+ I1 A/ \person whose parents are both Chinese  nationals  and  have  both  settled' ]# D1 V% K' Z$ N' U* w
abroad, or one of whose parents is a  Chinese  national  and  has  settled2 Z6 t0 F* f& i6 H/ f2 f2 X
abroad, and who has acquired foreign nationality at birth shall  not  have: h1 v  ^" O5 ^. _+ Z
Chinese nationality.

! y) {* v  @) j  {( I/ g/ ?# [( U3 JAny person born in China whose  parents  are  stateless  or  of  uncertain
2 b1 }5 I2 M! s$ A: {- fnationality and have settled in China shall have Chinese nationality.- q7 D5 v  _2 [2 m& e7 {
Article 7
! a; o3 S+ ?0 n+ ~/ f- B3 z% mForeign nationals or stateless persons who are willing to abide by China''s
7 d7 t. F6 c  x, F+ q1 dConstitution and laws and who meet one of the following conditions may  be% ^' ]! A9 d9 N* X! z
naturalized upon approval of their applications:
8 G% |( R& W/ X4 c6 C9 f6 r9 n; R(1) they are near relatives of Chinese nationals;/ J, K% `# k) x
(2) they have settled in China; or
" r3 H- E) l+ f( {9 f(3) they have other legitimate reasons.
& G$ A8 E# B1 o" GArticle 8
( r, \- t) G% ~  W2 dAny person who applies for naturalization  as  a  Chinese  national  shall
2 x- R0 M$ J! _# ?( A2 y: R; h7 Zacquire Chinese nationality upon approval of  his  application;  a  person* S9 M9 \; b$ g8 g
whose application for  naturalization  as  a  Chinese  national  has  been
6 r! j9 d( y# m7 \& v- Yapproved shall not retain foreign nationality., T$ v" q, X& \2 C
Article 9
1 \6 A+ O* c3 C- ~Any Chinese national who has settled abroad and who has  been  naturalized
. j& J* `, X; was a foreign national or has acquired foreign nationality of his own  free) y6 b  t1 |% |& v+ z- N+ F. e! k
will shall automatically lose Chinese nationality.: f6 @0 r/ e! h! R7 n$ C
Article 10
2 w$ _: B- O9 C+ _) l" d  k' `Chinese nationals who meet one of the following  conditions  may  renounce1 i9 B: B8 b. l" B, e& ?) ]
Chinese nationality upon approval of their applications:
. I: i- X1 B3 R- E& r- Y(1) they are near relatives of foreign nationals;
. C* c4 r  a4 e9 o(2) they have settled abroad; or  r' ^/ w' g" q. |0 t7 k5 V% i9 H
(3) they have other legitimate reasons.# @, C. N7 F  n2 A
Article 11. z) R5 f- C# e. ]: A
Any person who applies for renunciation of Chinese nationality shall  lose
  t0 M, y; a. z# h: l# UChinese nationality upon approval of his application.2 _+ d3 @7 z) H; c
Article 12
" h9 a3 R, s$ H  v9 G. w; OState functionaries and military personnel on  active  service  shall  not
& e! l% i- B3 R8 prenounce Chinese nationality.
7 U* [( t2 a, E, ]/ VArticle 13
' p; W3 A. ?, _; e7 U8 t+ z' }Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for
: i) v; |. S& W( x& lrestoration of Chinese nationality if they have legitimate reasons;  those  c# ~2 g- b: Z5 E( g/ q) ?% G% M
whose applications  for  restoration  of  Chinese  nationality  have  been
% t' }% D* @/ N! J: japproved shall not retain foreign nationality.
/ s2 ~9 w; q# R5 P/ h  DArticle 14$ C9 u' J5 J% f, x5 U
Persons who wish to acquire, renounce or restore Chinese nationality, with9 f( ?" P- n% `! o
the exception of the cases provided for in Article 9, shall go through the
$ U2 k; R5 T1 w7 j2 Xformalities of application.  Applications of persons under the age  of  18" @. o! K. {7 V: u3 k& }' S! d- M
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
, r0 L4 p+ l( U" Irepresentatives.
" G+ r3 e, S! G, `! ]$ T" RArticle 159 G: w0 _4 m0 A" q7 z2 M& ~
Nationality applications at home shall be handled by the  public  security
9 y6 I/ a. \, J) m. t0 v5 ]bureaus of the municipalities or counties where the applicants reside;% s+ y: h. b$ V- @3 F1 U
nationality applications abroad shall be  handled  by  China''s  diplomatic
# S0 o3 U1 O/ [1 ^) j/ C1 nrepresentative agencies and consular offices.; ]1 a. `1 j& V! T
Article 16
7 b4 `* t+ p: v0 ?5 i# k6 kApplications for naturalization as Chinese nationals and for  renunciation: `7 z" m5 [2 ~0 [3 l; u" P
or restoration of Chinese  nationality  are  subject  to  examination  and
. O. y  Q% i8 v" w# ~approval by the Ministry of Public Security of the  People''s  Republic  of0 P. l* Y$ Y% i% k8 H( l
China. The Ministry of Public Security shall issue a  certificate  to  any# ?" k* K7 Q6 a& I
person whose application has been approved., n& I: }3 \+ B% V# [" c
Article 17  k% [/ G1 `( t; {" n. g
The nationality status of  persons  who  have  acquired  or  lost  Chinese
: j# ^% s; N$ e; K' ]nationality before the promulgation of this Law shall remain valid.
; J- F3 x; U0 MArticle 18$ R# a0 m+ y, q6 t' ~5 g; d* Y4 L
This Law shall come into force on the day of its promulgation.
