) D( e( O/ O; }' \2 c) { 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
2 A: |2 ^9 ]! r+ t+ c7 e7 u 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。/ T$ `/ Y& P* ?/ l# a
第三条 中华人民共和国不承认中国公民具有双重国籍。
5 L8 d5 _6 x5 P# X 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
& ]* G1 Y1 V c! \' Z) u2 k$ N% ? 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。

第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:2 z- j, O% h- y+ i/ G. Z
一、中国人的近亲属;

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
: ]! c4 g8 P3 T% W* m" a' o& k 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。6 d8 g* w# ]1 E4 O# P* q. v
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:2 [' i8 u- v6 N- z7 W
一、外国人的近亲属;! h7 `0 i+ N4 l( E
二、定居在外国的;

第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。( O5 p6 _! f) [6 x
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。* b7 A( t3 Q: \4 s2 X; t5 v
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。; F7 s d# B' o* e8 N
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。5 o8 E n$ D$ m j0 E7 k
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。/ q; R9 L/ D' G/ d7 ^) v) L
第十八条 本法自公布之日起施行。

Any person born abroad whose parents are both Chinese nationals or one of

person whose parents are both Chinese nationals and have both settled% n5 t8 @: k. ^; Q' o9 E) N
abroad, or one of whose parents is a Chinese national and has settled

naturalized upon approval of their applications:

Article 8
* p4 s8 @9 Z' ~+ ~) ~" BAny person who applies for naturalization as a Chinese national shall( d: r$ X) d8 z! i0 o1 s
acquire Chinese nationality upon approval of his application; a person
5 O' I0 S2 r" c; @5 uwhose application for naturalization as a Chinese national has been
* \- J1 r" H- l2 @1 J; Happroved shall not retain foreign nationality.
! V) d8 K, k, ^Article 9
. w: s" b* k: [' T3 Z, tAny Chinese national who has settled abroad and who has been naturalized- K$ V% [+ R7 {9 c6 G" d
as a foreign national or has acquired foreign nationality of his own free
, K( }( P: E) D( ^ M5 R5 Y7 Lwill shall automatically lose Chinese nationality.' C/ D* }& b6 x6 q5 J* @- O$ |
Article 10
' F N7 s8 w* O& vChinese nationals who meet one of the following conditions may renounce' `1 [/ ^# [ I: N$ i( g5 ]
Chinese nationality upon approval of their applications:

Article 11
; ^" ~: ~4 f7 `5 [Any person who applies for renunciation of Chinese nationality shall lose

Article 12
2 j) d% R) }9 K4 J2 gState functionaries and military personnel on active service shall not
5 o" s( v, y& [, Z& ^renounce Chinese nationality., V- P% e# E8 W5 X4 k
Article 13
/ M; n9 `: Q0 u4 _! y2 ^Foreign nationals who once held Chinese nationality may apply for' r4 ~+ r* I- |
restoration of Chinese nationality if they have legitimate reasons; those0 P) m5 i! S$ Y Y/ T
whose applications for restoration of Chinese nationality have been1 w9 |; r6 a& h9 J7 f
approved shall not retain foreign nationality.
2 I+ n0 D A7 ~% F! TArticle 14( g& J7 y; J: q* `9 S7 u
Persons who wish to acquire, renounce or restore Chinese nationality, with
( R% y* k+ `# _3 D2 jthe exception of the cases provided for in Article 9, shall go through the
* B( M" f" J1 |0 x! g; iformalities of application. Applications of persons under the age of 18
9 H" d- ^, a$ u% q5 o% Ymay be filed on their behalf by their parents or other legal7 Y2 \, h: M* \5 \4 [0 D. D
representatives.

+ Y5 U0 A/ @% s0 ^# ]7 B+ uNationality applications at home shall be handled by the public security
5 R* n k3 I" D& }, l' f3 Zbureaus of the municipalities or counties where the applicants reside;7 V! K$ J+ s) x. g+ {
nationality applications abroad shall be handled by China''s diplomatic
8 P* a& t! @" R0 t* y- a B: ]+ rrepresentative agencies and consular offices.
+ N Y$ a$ e2 X3 p& `# M, x8 kArticle 164 `0 ]1 K# l- ]4 t
Applications for naturalization as Chinese nationals and for renunciation" j( n1 G. J9 X0 y" }
or restoration of Chinese nationality are subject to examination and4 _8 `2 l5 H5 ]6 {6 b; R
approval by the Ministry of Public Security of the People''s Republic of
) L/ w t" a4 @( DChina. The Ministry of Public Security shall issue a certificate to any& `; g- K. g: R. w& `- C9 D
person whose application has been approved.( m+ F6 U1 {0 ?0 h3 G/ t( B) q3 \6 X

The nationality status of persons who have acquired or lost Chinese# Z; u7 ?+ S I! t; B% R
nationality before the promulgation of this Law shall remain valid.& J+ l, S6 ^% t( J8 I& R
Article 18
2 ` q$ c* k7 e7 B O- ]This Law shall come into force on the day of its promulgation. |
