《中华人民共和国国籍法》
, C+ @$ [. ]/ p, Q4 x, a6 R  ; A2 n& U* m" @  V: ]  h7 ?
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
& ?6 M1 F& {4 }% R    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
$ R/ j, C) w, m5 E5 }& r    第三条    中华人民共和国不承认中国公民具有双重国籍。7 U* r  U" Q: M) K
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
4 B) y2 i5 o( i* p% a/ ^; C    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
8 O' q/ G1 H+ d    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。! J$ w+ I5 D5 I& W: U- d5 |
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

    二、定居在中国的;
! z' x" m. d8 D2 q& b' ^. ]  V    三、有其它正当理由。2 |: T3 {8 Z6 F- Z
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
& a2 T0 Q. |" i5 f0 y    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
5 F0 z+ Z4 d' s/ ~( \0 e# p& j& \( F    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:+ H) x9 O# z1 w8 U6 {" l
    一、外国人的近亲属;9 Y4 q$ s/ ?# V  N1 G( N- H" p
    二、定居在外国的;& f! ~9 D; w$ C9 A4 G
    三、有其它正当理由。" T$ s* h  [8 i0 S* j4 g8 W4 Z
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
8 [: u3 O: _! H1 i    第十二条   国家工作人员和现役军人,不得退出中国国籍。
  E, P0 |% b2 G$ O    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
: J7 |8 E- W# v1 Q8 F    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。( {1 P, M: }5 w& V8 g
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
' Q3 r1 Z  c* ~    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
% U* C; V2 r9 Z' L! U    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。
7 @, \: ~4 q  K, E    第十八条   本法自公布之日起施行。

Article 1
) y, e1 w$ \) f7 c$ r: DThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of0 b( J( O: ~5 e. N& V' ?
nationality of the People''s Republic of China.$ z% \0 K3 `1 d6 c; }: @8 D$ h! O
Article 2
" r1 j$ d# I2 z" k  f" r! U8 xThe People''s Republic of China is a unitary multinational  state;  persons" K& N  V! \& x# H
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
( K' P, _, G6 e$ e& nnationality.2 y' p4 a) w! q6 Z. o
Article 3) W& R  |! ]0 _3 s0 Y
The People''s Republic of China does not recognize dual nationality for any
; B8 r1 Z  m- C5 }* J3 _8 m) @Chinese national.
8 [% L: @/ T; R" _& G4 P  i7 pArticle 4- a0 G; C0 \: ]: a' C- z) V' X
Any person born in China whose parents are both Chinese nationals  or  one. C8 k5 q4 @( k  x6 r+ D- K/ h
of whose parents is a Chinese national shall have Chinese nationality., p1 o! e2 I7 ^& D$ K4 l' ~
Article 5
' C3 D3 F' E- k3 xAny person born abroad whose parents are both Chinese nationals or one  of
. ?# V; n6 L( k/ Mwhose parents is a Chinese national shall have Chinese nationality. But  a4 e( r2 N; o* k  G8 P% [+ X
person whose parents are both Chinese  nationals  and  have  both  settled
5 m( F3 x, z" \3 xabroad, or one of whose parents is a  Chinese  national  and  has  settled
+ z1 D- a3 q) Z; L2 X: Yabroad, and who has acquired foreign nationality at birth shall  not  have
* P- \" u0 {" N9 s$ Z1 }  RChinese nationality., T3 O, h% x; u" I) h. @
Article 6
, c2 N+ \  I5 PAny person born in China whose  parents  are  stateless  or  of  uncertain
% X8 ?" |7 o( `$ B/ onationality and have settled in China shall have Chinese nationality.
# K2 G$ l0 m; z0 C9 e, jArticle 73 r( h: ]* C* [! X
Foreign nationals or stateless persons who are willing to abide by China''s
( ?3 {3 J1 B& B" B: z% X8 E) eConstitution and laws and who meet one of the following conditions may  be
" A" j( h/ ]$ S( b5 i9 z! P8 Cnaturalized upon approval of their applications:
* c6 R- E5 ^0 v+ W0 A  T) h(1) they are near relatives of Chinese nationals;
$ x. ?4 f! L2 k. i: [(2) they have settled in China; or
( D2 ]  a  [" P: m# m/ w(3) they have other legitimate reasons.
. }$ {* [5 Z7 B) I( g; }7 M( jArticle 8
! X- c: K5 B. CAny person who applies for naturalization  as  a  Chinese  national  shall7 ^, h' Z1 L- p% `0 A& c: @
acquire Chinese nationality upon approval of  his  application;  a  person" C4 H' A- m$ C- j( `) u+ f; L9 k8 |
whose application for  naturalization  as  a  Chinese  national  has  been
# c" r# o9 W' V, ^4 E5 f6 K1 I1 {7 U/ ^approved shall not retain foreign nationality.% M! {& W; E* V# x: |0 m+ E2 j
Article 9
5 Q5 k5 }3 ^/ O0 O* TAny Chinese national who has settled abroad and who has  been  naturalized
+ V0 C% p8 \9 o7 Y+ O' das a foreign national or has acquired foreign nationality of his own  free
: ~4 `, N$ q# F) w* m% X) \will shall automatically lose Chinese nationality.1 e2 h# W: b. b2 J7 a4 j: F. p, E
Article 10$ \( a2 l6 e. ]0 B/ r7 e
Chinese nationals who meet one of the following  conditions  may  renounce- A/ I: Q# o$ G. W
Chinese nationality upon approval of their applications:
& J; U5 k  K# X* L4 W% i(1) they are near relatives of foreign nationals;
$ ?/ u0 x- q; I' N- A4 H) ^9 m(2) they have settled abroad; or; c: x: ?( z! A' i5 D1 {: n* p
(3) they have other legitimate reasons.+ K* V+ l/ w/ o3 p4 X
Article 11( c. q+ M! f0 x% u
Any person who applies for renunciation of Chinese nationality shall  lose+ h0 P) Y+ b! X
Chinese nationality upon approval of his application.
1 W" J' c" K/ ^0 bArticle 12. i8 Z' \- g; {* ^0 Y
State functionaries and military personnel on  active  service  shall  not# c& v8 S2 v! y: A
renounce Chinese nationality.' R. d+ O8 ?+ v* D( |
Article 13
5 N, K3 W2 f& F& V5 x3 F, xForeign  nationals  who  once  held  Chinese  nationality  may  apply  for  ^+ x! P# d8 Z, \7 X
restoration of Chinese nationality if they have legitimate reasons;  those
' u' z- Q1 w' H9 ~$ e# m" H; o' u+ zwhose applications  for  restoration  of  Chinese  nationality  have  been4 u+ }: {' x# a5 l4 N. z0 p
approved shall not retain foreign nationality.1 Z6 C! _( N; L4 B; \  b( J
Article 14
% w! l9 q* n- Z: ~, ?5 oPersons who wish to acquire, renounce or restore Chinese nationality, with
" s9 z, }8 a& O) mthe exception of the cases provided for in Article 9, shall go through the
  f% ^% E( m9 Q$ f* c! E  _' w/ lformalities of application.  Applications of persons under the age  of  18
, a* t& t1 L  w0 |2 Z1 lmay  be  filed  on  their  behalf  by  their  parents   or   other   legal
2 @/ j$ V& O6 u+ Qrepresentatives., c0 U# r: R- a  |5 Q4 S
Article 15
" {! r( V9 f  W' qNationality applications at home shall be handled by the  public  security
1 T0 T) _6 e% P! f1 E; bbureaus of the municipalities or counties where the applicants reside;* Z% M" G4 D$ X) n: E8 j
nationality applications abroad shall be  handled  by  China''s  diplomatic) @4 ~4 |# O: H% @& N! }. U1 ?
representative agencies and consular offices.) n& V+ }! Z2 @" \- v4 m
Article 16' G7 `4 F" b  ^$ B, g
Applications for naturalization as Chinese nationals and for  renunciation: H# A9 I. R3 j( d5 t
or restoration of Chinese  nationality  are  subject  to  examination  and
$ w" j( u" X- S) M9 R* Lapproval by the Ministry of Public Security of the  People''s  Republic  of8 L9 w9 @( w& t8 T; ^* ^
China. The Ministry of Public Security shall issue a  certificate  to  any8 E, _0 e/ |/ L$ [$ i0 D
person whose application has been approved.
( V8 F  J! P" a3 R: e" u& m) B4 EArticle 17
/ @0 o, }$ o% A- U. I" zThe nationality status of  persons  who  have  acquired  or  lost  Chinese
( m2 v% f6 K. W% H$ ~nationality before the promulgation of this Law shall remain valid.5 x% ?9 s5 e2 R4 Q
Article 18
! F1 g: b& c. j6 e) i8 R+ zThis Law shall come into force on the day of its promulgation.
