6 V# A  a! \) `: W& v/ I- I. h$ M 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。7 O# x. `1 X+ A& u0 }+ |2 z- i
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。2 q  u( ^; g, l' ^* |" f% B
    第三条    中华人民共和国不承认中国公民具有双重国籍。, c# k! v. U+ y
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。) p2 {. x9 A( w  I, }5 q0 N! s1 T
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
; N. ]- P4 i% C5 O! A    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
8 q: U, z( S; b9 D( o- @    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:% S" z. A, F) |3 @" f
    一、中国人的近亲属;
9 ?8 O  ?1 R! b6 t5 i    二、定居在中国的;  R9 S/ D, e! s4 h5 R
    三、有其它正当理由。
8 \  r! r4 }9 o( @    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
; F7 O8 L) h. R3 |    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
" Z6 j6 x! L* M+ `# F6 H- o    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:1 b- U. d- n! x+ r5 L
    一、外国人的近亲属;+ R% e1 d+ v  w' ?5 u8 f
    二、定居在外国的;6 v! d* r% y$ H5 x% B
    三、有其它正当理由。$ ]/ C% l) D8 l6 S- N
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。' r: n7 d6 @1 x$ J/ O. _( m# a9 m" V
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
* n$ k) X: W  S; Z    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。7 c, t! F$ |7 N/ u" g
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。$ H% |+ e9 `9 P  x$ B
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。4 Q" X2 A6 i, L+ @* Y+ Q1 I
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

    第十八条   本法自公布之日起施行。

Congress, promulgated by Order No. 8  of  the  Chairman  of  the  Standing

This Law is  applicable  to  the  acquisition,  loss  and  restoration  of- p0 D* I; h$ _
nationality of the People''s Republic of China.) p3 X0 |+ K9 W, N; z6 d& }% _
Article 2
- {) K% y" P' W% I5 uThe People''s Republic of China is a unitary multinational  state;  persons
* R. Y9 K" e: _+ k6 rbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese
% T4 c2 a- P  V) M9 A, Anationality.
: A5 z0 O3 B; C& q) V& z  MArticle 3
( p# G9 a6 @+ X* `! }/ R( P7 rThe People''s Republic of China does not recognize dual nationality for any
2 B- g$ X$ z! L1 ~) ?+ M+ c- S6 uChinese national.

- l9 y  B. S! c7 cAny person born in China whose parents are both Chinese nationals  or  one' m) M% n4 x( e2 w7 `; j; p  Y% }
of whose parents is a Chinese national shall have Chinese nationality.

, ?4 B; [1 s8 A' @Any person born abroad whose parents are both Chinese nationals or one  of
9 I% y& m7 ^% u, V+ z( H# Rwhose parents is a Chinese national shall have Chinese nationality. But  a
1 F7 ]! B1 D+ m' T4 }person whose parents are both Chinese  nationals  and  have  both  settled
" U1 M" e( ~6 habroad, or one of whose parents is a  Chinese  national  and  has  settled5 k2 }! i8 y- O5 H4 @8 p* D
abroad, and who has acquired foreign nationality at birth shall  not  have& v" ]+ d7 y: }4 l( M. ~
Chinese nationality.# u, b3 n1 |1 _8 @! N
Article 6
$ Y9 O' ]" z$ R0 t, dAny person born in China whose  parents  are  stateless  or  of  uncertain2 V3 ^+ Y+ B) h1 d4 W* Q, b7 p
nationality and have settled in China shall have Chinese nationality.
; T8 D, I8 a, o4 ~2 ?) l; j9 |* {. BArticle 77 X1 X; g2 x9 r/ P* I' H
Foreign nationals or stateless persons who are willing to abide by China''s
# R, q3 G# p, V9 }Constitution and laws and who meet one of the following conditions may  be
+ |2 R6 O( ~& y1 W4 Lnaturalized upon approval of their applications:
+ C. B; i9 ~) ~, O(1) they are near relatives of Chinese nationals;
8 R) d' R( i7 Q(2) they have settled in China; or- [8 Z4 C2 V4 g0 a0 _7 G" L$ ~" G
(3) they have other legitimate reasons.1 |! {( ~' z* ]
Article 82 z$ G4 U/ N; w3 _5 u8 g: Q3 i
Any person who applies for naturalization  as  a  Chinese  national  shall
2 s3 n3 o" o7 C' {! E9 H5 yacquire Chinese nationality upon approval of  his  application;  a  person
4 A2 J, r  l. U, o+ U# K. ^whose application for  naturalization  as  a  Chinese  national  has  been
& M6 k* G. ?# r  bapproved shall not retain foreign nationality.* I: S8 ~& @8 j" l
Article 9. |) _% z5 E5 ]7 \- x7 G( L
Any Chinese national who has settled abroad and who has  been  naturalized
5 |, @$ S; j) \' L4 Tas a foreign national or has acquired foreign nationality of his own  free9 g! `8 S- e6 b: R# q, u6 U, ~5 ?
will shall automatically lose Chinese nationality.
2 Y/ V7 _7 {6 OArticle 10% e0 |% H0 n) @9 [! z
Chinese nationals who meet one of the following  conditions  may  renounce9 ~8 P1 G! I8 y
Chinese nationality upon approval of their applications:7 y6 M  u0 o. o7 @* x3 o
(1) they are near relatives of foreign nationals;
2 ?) A) f" |) \6 R* l(2) they have settled abroad; or
" X* @% U) Y$ ~( L(3) they have other legitimate reasons.
+ Q. J& _8 Q  D# i8 \Article 11, a; z6 Y! e1 a  U3 d! b$ O
Any person who applies for renunciation of Chinese nationality shall  lose
( l' _- i% ?7 ?! C  JChinese nationality upon approval of his application.
4 c- j) z6 |; h5 \Article 122 S$ G% M$ p7 m- d. ]
State functionaries and military personnel on  active  service  shall  not
! V2 z5 Q  j- ?. p% Zrenounce Chinese nationality.
4 w4 ^# p% ?2 K1 @4 O4 fArticle 13
7 M8 G* ^: y* e! |Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for
( W: r" i- D3 a0 K' Z$ F: c- T2 Vrestoration of Chinese nationality if they have legitimate reasons;  those
7 h. I& D7 w6 e0 h6 Dwhose applications  for  restoration  of  Chinese  nationality  have  been
# {0 P& M, ~9 q) p& x/ lapproved shall not retain foreign nationality.2 W* G( D8 ^* G. P1 d( t) s
Article 14
3 H2 g1 O9 I% A3 n3 D- }Persons who wish to acquire, renounce or restore Chinese nationality, with
1 U7 P3 W% J, pthe exception of the cases provided for in Article 9, shall go through the1 H2 [. f+ N# p: A- U
formalities of application.  Applications of persons under the age  of  18. A: g+ c& i  D1 H, c7 o7 v
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
3 D# W, s& \$ l7 R8 Brepresentatives.  z+ r( b( f3 }& R0 V; y; s
Article 15& }6 I4 x0 \& @1 P7 W
Nationality applications at home shall be handled by the  public  security2 G% e# q* h! B' K  u5 h
bureaus of the municipalities or counties where the applicants reside;1 V4 u2 g- y" w, {8 V# q' \/ q
nationality applications abroad shall be  handled  by  China''s  diplomatic
: G- j, ?, D7 v9 T  H/ F% x  O1 Urepresentative agencies and consular offices.3 M/ ]5 W/ r* o  A! b7 {
Article 16* J% @  L9 L9 A3 \) [5 k
Applications for naturalization as Chinese nationals and for  renunciation
8 |5 [3 t; r! U( W& ?7 w1 e5 Dor restoration of Chinese  nationality  are  subject  to  examination  and: R, F0 c6 x+ F3 Y
approval by the Ministry of Public Security of the  People''s  Republic  of+ [  M  E$ P" j4 u& @) R/ Y
China. The Ministry of Public Security shall issue a  certificate  to  any3 u: R; D0 Z6 `1 z0 I+ }5 c- O8 |
person whose application has been approved.$ ]( A1 V, D- g0 O/ S0 E0 I
Article 17
1 A  ]6 s" @% [0 ?The nationality status of  persons  who  have  acquired  or  lost  Chinese! M# y0 Z; }/ f& d
nationality before the promulgation of this Law shall remain valid.
) B+ {' I% o% j. b( [Article 187 [) K# j5 F3 C
This Law shall come into force on the day of its promulgation.
