  1 o* W+ f" W1 F
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
/ p4 w9 [, f, U    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
, N4 C. x7 i, R4 v    第三条    中华人民共和国不承认中国公民具有双重国籍。
1 W9 Q' q! \$ J4 X    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
: `1 u. @& T/ B, V    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
* ~, D) h0 z; j$ n# ^4 o5 S    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。6 Y$ p2 F- U/ i% |) w  {
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
8 L( `9 j5 {1 c& O7 R    一、中国人的近亲属;
0 j& ?- n/ i3 a2 w) h! u    二、定居在中国的;
' ^# {1 u1 G' }1 L) W2 C, a7 E    三、有其它正当理由。
. S' A( v: [, v( r/ G* A  C: w    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
/ h# g0 ^9 G- m! E    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
/ B" P/ h2 c# ]& v% z    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
1 g; P- M  n: {9 h' d0 Z    一、外国人的近亲属;7 H2 P% h! G5 O( g
    二、定居在外国的;/ N9 v" N( S$ x" V8 i/ d" L1 K
    三、有其它正当理由。
# o% O' m: ?1 J& s8 k6 Z1 S9 Z, I7 o2 ?    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
0 o* L- i$ M, _. [2 b0 T    第十二条   国家工作人员和现役军人,不得退出中国国籍。& M9 x$ X# w9 U
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
8 e% e8 }, |" X7 S) z: I3 ^, R1 _8 y    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。. o  M' v; h( u
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。8 Y& C+ \6 d* l3 e
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
0 B0 p( {# Q5 D, I' O" h    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 1# G: j% h( }7 v
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of
6 i) @' c9 |( ~nationality of the People''s Republic of China.
# P1 o/ ~  O( G" c9 \Article 2$ g* }2 l0 J7 `
The People''s Republic of China is a unitary multinational  state;  persons
# _* t' P5 d6 W; B) K* o; rbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese
7 D0 m- p( A" _9 c4 \/ u3 x& H" `/ Jnationality.$ ]- K' c8 |% D, T$ k
Article 3" C/ K; g8 K) `: X& \2 |% K
The People''s Republic of China does not recognize dual nationality for any& y: f4 D. `/ [/ K( Q4 t" u3 R. w
Chinese national.' [) s8 w: ?& O5 P6 g9 x4 j
Article 4  e9 A5 [+ L. s0 Y- L. Q
Any person born in China whose parents are both Chinese nationals  or  one- x0 t# ]5 Y0 C5 r/ Y7 e  |
of whose parents is a Chinese national shall have Chinese nationality.: _% [* G$ d, U" k; r" X7 I# v
Article 53 F2 d3 q; R( c. G: u& F/ g6 O0 l
Any person born abroad whose parents are both Chinese nationals or one  of
+ b  U9 z" T" M8 |2 y1 k$ N' o4 twhose parents is a Chinese national shall have Chinese nationality. But  a
+ w0 p* b4 V! Operson whose parents are both Chinese  nationals  and  have  both  settled
$ A+ Y6 i9 e, aabroad, or one of whose parents is a  Chinese  national  and  has  settled
  w5 p9 l# [! Z0 Babroad, and who has acquired foreign nationality at birth shall  not  have
. D7 q7 d' z# b" R" L; _Chinese nationality.
% C& `  q! p. d7 HArticle 6
& b. y8 ]5 L: A1 G' VAny person born in China whose  parents  are  stateless  or  of  uncertain
, e$ `0 E- W( a  r  inationality and have settled in China shall have Chinese nationality.
$ v( u* J* ]# s1 O* Z% aArticle 7' i# z( G8 P& B+ n4 L  p. a1 w
Foreign nationals or stateless persons who are willing to abide by China''s
' G( s: C# u, q8 G% t' FConstitution and laws and who meet one of the following conditions may  be& a' s; g0 A9 E8 G. n: x
naturalized upon approval of their applications:
$ z( a6 K0 Q, n& |' M3 |(1) they are near relatives of Chinese nationals;: L2 g2 ^7 }0 X
(2) they have settled in China; or
. U* a9 M" w; X7 q' B3 `, U(3) they have other legitimate reasons.
9 ?( r- n$ W& [3 \Article 84 R$ D# Y7 [; G; O
Any person who applies for naturalization  as  a  Chinese  national  shall6 d# H: _  u* }: J
acquire Chinese nationality upon approval of  his  application;  a  person6 Y7 y; t5 l% R9 d" p
whose application for  naturalization  as  a  Chinese  national  has  been
5 }) d, s: i) ^* L) f! O( sapproved shall not retain foreign nationality.  Q* W3 e- H3 P2 |8 Z# c  k. i
Article 9
! ~1 y" {) k# q9 K7 g# VAny Chinese national who has settled abroad and who has  been  naturalized
9 g5 r  E, g8 R4 {( e8 y# a) b) Gas a foreign national or has acquired foreign nationality of his own  free# t9 F& H2 J* Y9 j0 p& C
will shall automatically lose Chinese nationality.
3 ]7 Q3 X) f* {, W& NArticle 10
3 S# O! j, O2 wChinese nationals who meet one of the following  conditions  may  renounce
9 v8 m" B, R6 d* y" z1 R, [Chinese nationality upon approval of their applications:
" J2 R) N/ k0 O; B" ?: ~" P5 I(1) they are near relatives of foreign nationals;+ C) d# j- w- _- a$ D3 i/ U' o
(2) they have settled abroad; or
+ t6 c. z% D+ C/ V9 ~* p(3) they have other legitimate reasons.
+ _0 i* X4 Z9 G! CArticle 11$ U# J' h  a3 T% M, t
Any person who applies for renunciation of Chinese nationality shall  lose
& l" e% i6 r9 x& e4 E- O$ qChinese nationality upon approval of his application.! U# Z" W& U. ]) m
Article 12+ r( Q& X9 ]: ^; E2 D7 u
State functionaries and military personnel on  active  service  shall  not6 M, W) ^6 F* t7 V: n
renounce Chinese nationality.6 Z$ e$ l+ |7 G9 a0 z
Article 13
: @5 i$ o$ X' ~* jForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
: o; r9 `/ A, @$ q% srestoration of Chinese nationality if they have legitimate reasons;  those, J  y0 @' W& v7 B! X
whose applications  for  restoration  of  Chinese  nationality  have  been: T; F3 s' i3 |) y/ f
approved shall not retain foreign nationality.
7 f/ D2 u5 ?3 X" sArticle 14: p9 a* p% {! `0 n- H
Persons who wish to acquire, renounce or restore Chinese nationality, with
4 ^9 v2 W; d% H$ M; V4 rthe exception of the cases provided for in Article 9, shall go through the: ~% s: B. _- Y6 B  V7 |
formalities of application.  Applications of persons under the age  of  18' V2 m' W* C4 x3 n9 j3 u5 j' C3 q
may  be  filed  on  their  behalf  by  their  parents   or   other   legal3 j0 Q7 Y' s& B! e9 ]' O  L2 _+ `
representatives.# b, v6 Y8 [: @3 n' j
Article 15" d! z8 D3 J6 _
Nationality applications at home shall be handled by the  public  security5 U+ |6 D0 P2 l) b
bureaus of the municipalities or counties where the applicants reside;3 x( P2 f3 E) `9 p9 Z& U, _
nationality applications abroad shall be  handled  by  China''s  diplomatic5 k0 y% Y* D1 ]/ y
representative agencies and consular offices.. }$ B  k% @5 }% Q( J( F9 b/ U; D
Article 16
7 e. s/ c9 K2 K% x  G  YApplications for naturalization as Chinese nationals and for  renunciation
0 z# Y  H( f3 P% m! o) l* ?% Vor restoration of Chinese  nationality  are  subject  to  examination  and( T3 R  x% d# h8 u5 r; ~' j. W
approval by the Ministry of Public Security of the  People''s  Republic  of- ?7 n) l( N# }" m; P) ^! d% ^
China. The Ministry of Public Security shall issue a  certificate  to  any
' B! ^! k4 v5 a% Bperson whose application has been approved.
# i8 c9 {: U& k# ]# S1 S" S. ZArticle 17
: U% k* t( S6 e/ J+ @The nationality status of  persons  who  have  acquired  or  lost  Chinese* Y7 |8 y9 l" O% G
nationality before the promulgation of this Law shall remain valid.) X/ r9 o9 B: n! o
Article 18: @! I/ ]& ~9 ^+ l1 r( o" G
This Law shall come into force on the day of its promulgation.
